Welcome to TaoMix 2 a service offers by Roger McAdams (« we », « us » « our ») and our Terms and Conditions of Use. This affects TaoMix 2 usage (« mobile application »).
These Conditions of Use, our Privacy Policy, and the Community Rules, constitute a legal agreement, which is a contract (the « Agreement ») between you and Roger McAdams, concerning the TaoMix 2 usage.
Children who have less than 13 years old are not authorized to use the service or try to sign up.
IF YOU DON’T AGREE WITH THESE TERMS, THEN PLEASE DON’T USE THE SERVICE.
Please read these Terms of Use very carefully. If you do not agree to any of the provisions set out in those documents, you should not use the Apps or any of the Services. By accessing or using the Platform you represent and warrant that you have read and understood the Terms of Use, will abide by them, and that you are either 18 years of age or more, or you are 13 years of age or more and have your parent(s)’ or legal guardian(s)’ permission to use the Platform.
We reserve the right to change, alter, replace or otherwise modify these Terms of Use at any time. The date of last modification is stated at the end of these Terms of Use. It is your responsibility to check this page from time to time for updates.
Taomix 2 allows you to create “Soundscapes”, a mix that you create by combining various sounds. The sounds used to create Soundscapes come from a variety of sources, including sounds we have created, sounds for which we have obtained licenses for use in the Services, sounds you create or record with your Device and sounds you import into the Application from other sources. These Soundscapes can be shared by you via various methods (as more fully outlined in the Privacy Policy), as the Services create a unique link which you may share from within the Application.
Please, note that for a best experience, we recommend to use headphones or speakers.
TaoMix 2 does NOT store or host any of the 3rd party content.
You acknowledge and agree that TaoMix 2 is not responsible or liable in any manner for any Third Party Content and undertakes no responsibility to update or review any Third Party Content. Users use such Third Party Content contained therein at their own risk. This provision will survive the use of the Service.
The app is provided « As is », « as available », and « with all faults ».
Whilst TaoMix 2 uses reasonable endeavours to correct any errors or omissions in the app as soon as practicable once they have been brought to TaoMix 2’s attention, TaoMix 2 makes no promises, guarantees, representations or warranties of any kind whatsoever (express or implied).
TaoMix 2 does not warrant that your use of the App will be uninterrupted, timely, secure or error-free, that defect will be corrected, or that the App is or will be free of viruses or other harmful components.
The Application allows you to import your own sounds, and to create sounds using your Device’s microphone, for use in creating Soundscapes. These sounds may include voice recordings. You acknowledge and agree that you shall not include in your imported or created sounds any speech that: (i) is unlawful, such as speech that is threatening, abusive, harassing, defamatory, libelous, fraudulent, invasive of another’s privacy, or otherwise tortuous; (ii) is racist, sexist, homophobic, or otherwise offensive to any minority or group; (iii) contains adult content; or (iv) contains any commercial solicitations. The guidelines in the present paragraph shall be known in these Terms of Use as the “Speech Policy”.
You represent and warrant that you own the rights to those imported or created sounds, or have a license or other permission that allows you (i) to use those sounds in this manner.
Without limiting the general Disclaimers found further in these TOU, Roger McAdams and its Representatives will not be held liable for any losses or damages, direct or indirect, pecuniary or non-pecuniary, resulting from your violation of: (i) the Speech Policy; or (ii) the Intellectual Property Rights of any third party in violation of this section.
Soundscapes that you create are proprietary to you. However, by using the Services, you hereby grant Roger McAdams a worldwide, non-exclusive, royalty-free, sub-licensable and transferable license to use, edit, modify, translate, copy, reproduce, transmit, distribute, display, and / or perform and otherwise fully exploit the Soundscapes in any media formats and through any and all media channels (whether known or unknown) without any compensation to you. You acknowledge and agree that once you have shared a Soundscape via the sharing function, you will be unable to remove the Soundscape from our servers. Roger McAdams retains the right, at our sole discretion, to remove your Soundscape(s) from our servers or remove the URL where a Soundscape is shared for any reason, including but not limited to whether you have violated these Terms of Use in general or the Speech Policy in particular. You understand and agree that Roger McAdams may retain, but not display or distribute, server copies of Soundscapes where we have removed the sharing URL.
Should one or more provisions of these Terms of Use be found to be unlawful, void or unenforceable, such provision(s) shall be deemed severable and will not affect the validity and/or enforceability of the remaining provisions of the Terms of Use, which will remain in full force and effect.
You agree that we may, in our sole discretion, terminate or suspend your access to all or part of the app with or without notice and for any reason, including, without limitation, breach of these Terms of Use. Any suspected fraudulent, abusive or illegal activity may be grounds for terminating your relationship and may be referred to appropriate law enforcement authorities.
The TaoMix 2 app application is committed to protect your privacy. Most of our services can be enjoyed without having to communicate TaoMix 2 app your personal data, but in some cases it may be necessary to provide certain information to access services. This Privacy Policy describes the collection and processing of data in such cases. This privacy statement applies to services that are available on the TaoMix 2 app application.
When you download or update the application, we may collect and process some of your data, such as (i) the advertising ID of your device(s), (ii) technical data of your device(s) (which may include but is not limited to information such as the model name or number, brand, operating system, screen size, screen resolution, default language, time zone of your device(s), third party applications installed on your device(s)) and (iii) mobile operator-related data (which may include but is not limited to information such as the name of the operator and the SIM card country code).
If you decide to give your consent, your data can be used for the promotion of TaoMix 2 app activities. TaoMix 2 app may disclose personal information only if required by law or if we have the firm conviction that such action is necessary to:

The registration, if necessary, also enables the user to specify whether you want to be contacted by TaoMix 2 app and how such contacts should occur. TaoMix 2 app gives users all the tools they need to ensure that personal information is accurate and current.

You can also adjust the settings of your devices concerning your data processing. On these settings, you will be able to reset your device’s advertising ID and/or limit targeted advertising on your device.
We take data security seriously. We implement and maintain appropriate technical and organisational measures including resilient security systems and protocols to protect the personal data we store.
